These Terms of Sale constitute a legally binding agreement between you ("Customer", "you") and Fiorie Jewellery ("Fiorie", "we", "us", "our"), operated by Fiorie Jewellery (ABN 94723543574), Australia.
By placing an order through our website, social media channels, email, invoice, payment link, or consultation process, you agree to these Terms of Sale.
1. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law ("ACL").
Our goods come with guarantees that cannot be excluded under Australian Consumer Law.
If a product experiences a major failure, you may be entitled to a replacement or refund and compensation for any reasonably foreseeable loss or damage.
If a product does not meet consumer guarantees but the issue does not amount to a major failure, we may choose to repair, replace or rectify the issue within a reasonable timeframe.
2. Pricing & Quotes
All prices displayed on our website are in Australian Dollars (AUD).
Prices may change at any time without notice.
Custom quotations are valid for 30 days unless otherwise specified.
International orders may be subject to duties, taxes, VAT, customs fees or import charges imposed by the destination country. These charges are the responsibility of the recipient unless otherwise stated.
3. Orders
3.1 Placing an Order
When you place an order, you confirm that:

All information provided is accurate.

You have reviewed and approved the product specifications.

You have read and accepted these Terms of Sale.

You are authorised to use the payment method provided.
An order is not accepted until Fiorie confirms acceptance in writing.
3.2 Made-to-Order Products
The majority of Fiorie Jewellery products are custom made or made-to-order specifically for each customer.
Production generally begins once:
-
A deposit has been paid; and
-
Any required design details have been confirmed.
Once production has commenced, cancellations may not be possible.
3.3 Deposits
A 50% deposit is generally required before production begins.
Deposits are used to cover:
-
CAD design work
-
Diamond or gemstone sourcing
-
Materials procurement
-
Production commencement
For this reason, deposits are generally non-refundable once work has commenced, except where required by Australian Consumer Law.
3.4 Stone Selection & Approval
For lab diamond purchases, Fiorie Jewellery may provide details, certification information, photographs and/or videos of the selected diamond prior to production.
By approving a selected diamond, the customer acknowledges and accepts the characteristics of that specific stone, including but not limited to its colour, clarity, cut, proportions and appearance.
Once a diamond has been approved and production has commenced, the approved stone cannot be exchanged, substituted or changed due to a change of mind. Any request to source an alternative stone after approval may incur additional costs and production delays.
Where Fiorie Jewellery sources a diamond in accordance with the specifications agreed by the customer, the stone shall be deemed accepted upon written approval by the customer.
3.5 CAD Approvals
Where CAD renders are provided:

Customers are responsible for reviewing and approving all CAD designs carefully.

Approval of a CAD constitutes acceptance of the design.

Changes requested after approval may incur additional charges and production delays.
Fiorie is not responsible for design elements that were approved by the customer during the CAD process.
4. Production Timeframes
Most Fiorie Jewellery pieces are made to order.
Estimated production time is generally: 4–6 weeks from final approval and/or deposit payment.
Production timeframes are estimates only and are not guaranteed.
Delays may occur due to:

Supplier delays
-
Diamond availability
-
Public holidays
-
Courier disruptions
-
Customs processing
-
Events outside our reasonable control
We are not liable for losses arising from production or delivery delays.
5. Shipping & Delivery
Risk in the goods passes to you upon delivery.
Shipping timeframes provided are estimates only.
Fiorie is not responsible for delays caused by:

Couriers
-
Customs authorities
-
Weather events
-
Import processing
-
Circumstances beyond our control
Tracking information will be provided where available.
Signature on delivery may be required.
International Orders
The recipient is responsible for the below unless otherwise specified at checkout:

Import duties
-
VAT
-
Customs fees
-
Clearance charges
-
Compliance with local import regulations
Fiorie is not responsible for customs delays, import restrictions or fees imposed by destination countries.
6. Final Payment
Final payment is required before shipment or collection.
If final payment remains outstanding for more than 30 days after completion notification, Fiorie reserves the right to:

Cancel the order;
-
Retain any deposits already paid;
-
Resell or repurpose the item.
Reasonable attempts will be made to contact the customer before cancellation.
7. Returns, Refunds & Exchanges
7.1 Made-to-Order Items
Because our jewellery is custom made specifically for each customer, we do not offer refunds, exchanges or returns for:

Change of mind
-
Incorrect size selected by the customer
-
Personal preference
-
Delayed delivery caused by third parties
-
Custom design decisions approved by the customer
This policy applies only to the extent permitted by Australian Consumer Law.
Approved Stones
Where Fiorie Jewellery provides a customer with certification details, photographs, videos, or other information relating to a diamond or gemstone prior to production, the customer's written approval of that stone constitutes acceptance of the selected diamond or gemstone.
Once a diamond or gemstone has been approved and production has commenced, the item will not be eligible for refund, exchange, replacement, or cancellation due to a change of mind, personal preference, subjective dissatisfaction, or a later preference for an alternative stone.
This includes, but is not limited to, dissatisfaction with the stone's appearance, proportions, sparkle, colour, clarity, measurements, certification grading, or any characteristic that was disclosed or reasonably apparent at the time of approval.
Nothing in this clause excludes or limits any rights available to the customer under Australian Consumer Law.
7.2 Faulty Products
If you believe your item is faulty, please contact us within a reasonable period after receiving your order.
We may request:

Return of the item for inspection
Where a manufacturing fault is confirmed, Fiorie may repair, replace or refund the item as required under Australian Consumer Law.
7.3 Transit Damage
Any damage believed to have occurred during shipping must be reported within 3 business days of delivery. Supporting photographs may be required.
8. Ring Sizing
Customers are responsible for ensuring the ring size provided is correct.
If a resize is required after production:

Resize fees may apply.

Not all designs can be resized.
-
Some styles may require a full remake rather than resizing.
Fiorie will advise the available options after assessment.
9. Product Variations
Because gemstones and precious metals are natural or individually manufactured products:

Slight variations in colour, appearance and characteristics may occur.
-
Product photographs, renders and videos are illustrative only.
-
Screen displays may affect perceived colour and appearance.
These variations do not constitute faults.
10. Warranty
Solid gold jewellery purchased from Fiorie includes a 2-Year Manufacturing Warranty covering manufacturing defects.
The warranty does not cover:

Normal wear and tear
-
Scratches
-
Accidental damage
-
Misuse
-
Loss of stones caused by impact
-
Third-party repairs or modifications
Assessment is required before any warranty claim is approved.
11. Limitation of Liability
To the maximum extent permitted by law, Fiorie Jewellery's liability is limited to:

Repairing the goods;
-
Replacing the goods; or
-
Refunding the purchase price,
as required under Australian Consumer Law.
Fiorie is not liable for indirect, consequential or incidental losses arising from the use, delay, delivery or ownership of the goods.
12. Privacy
Any personal information collected by Fiorie Jewellery is handled in accordance with our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of New South Wales.
